Terms Of Use
Sahkuna spaces are located in community centers and are allocated at reduced costs to professional artists, for the purpose of promoting artistic activity in the fields of theater, acting and dance, including rehearsals, workshops, readings, auditions.
Sahkuna is entitled to determine, in accordance with its various agreements with artist organizations, whether a user meets the appropriate criteria for subsidized use of the space, and to require the user to present current membership documents in a relevant artist organization.
After the initial registration, the user will have the option of self-scheduling online at Sahkuna in two usage categories:
"Regular User" category: open to any artist or group that does not collect money for the activity in the space.
"Business User" category: any use of the space that is not intended for rehearsals and in which activity takes place in the style of a class, lesson, workshop or training, in which participants pay any monetary payment for participation, whether to the operator, teacher or instructor, to the group or to any other party. For the avoidance of doubt, collection of payment of any kind, including participation fees, registration fees or per-lesson payment, will be considered "business use."
Scheduling Method
Scheduling for use of spaces in the complex is done independently online through Sahkuna's scheduling system as a registered user.
Opening a User Account
To open a registered user card, contact the complex operator by email or phone and describe the user group, the identity of the users, confirmations of membership in artist organizations, if required, and the nature of the use of the space.
At the end of the booikng, a booking confirmation message will be sent automatically by email to the orderer, which will include the day, room, number of hours of use and the final price for payment.
The hourly usage rates set forth below are also published on the website and in the app at the time of booking. The rates are divided according to "regular user" and "business user" categories, and according to room sizes: large, medium, small. In any case of contradiction between the rates published on the website, the rate appearing in the order confirmation message sent to the email will prevail.
Scheduling Ranges
In the App a room can be ordered through the app with 16 hours' notice in advance and up to a month ahead.
Booking for other time ranges will be made by direct contact with the complex operator.
Booking Cancellation
An order can be cancelled without charge up to 24 hours before the start of the usage time. Users who are found to be ordering and cancelling frequently close to the usage time in a systematic manner, Sahkuna is entitled to block the user from the option of self-scheduling in the app, and to allow orders to be placed only through direct contact.
Charge Amount Payment will be charged according to the number of hours ordered in the complex, and not according to actual usage time. No credit will be given for hours that were ordered and not used, except as detailed below in the case of removal.
Charging and Payment Method
At the end of the month, a payment request will be sent to the user by email with details of monthly usage and a link to payment in a secure clearing terminal using a credit card. Immediately after payment, a digital invoice will be sent automatically. Payment can also be made in advance coordination by bank transfer. Payment by check or cash will not be possible, except by advance payment.
Late Fees Non-payment on time will result in late fees as detailed below:
if the payment request is not paid within 10 days from the date of its sending, Sahkuna is entitled to charge the user a fixed handling fee of 50 NIS, as well as annual late interest at a rate of 8 percent, calculated proportionally to the number of days of delay, starting from the date on which the payment date passed until the date of actual payment. A debt not paid within 10 days from the date of its sending will result in automatic blocking of the user from additional scheduling in the system, and all his/her future scheduling will be deleted.
Use Not as Declared
I am aware that if it is found that the use made of the room in the complex was not in accordance with its declared purposes, and in particular if it is not a use without profit intentions for artistic purposes, I will be charged according to the "business use" category, and this may result in blocking from the option of self-scheduling in the app.
Receipts
I hereby authorize Sahkuna to send me receipts and invoices by digital means.
Terms of Use of Rehearsal Spaces in the Sahkuna Complex
The orderer undertakes to make proper use of the space and to maintain its cleanliness and proper condition. Soiling of furniture, including walls, must be avoided, and the space must be returned to its original state at the end of use, including returning every item to its place and disposing of garbage in the bin.
These instructions also apply to the use of the kitchenette.
It is the orderer's responsibility to maintain the equipment in the space.
Equipment must not be removed from the space at any stage, not even during artistic activity.
If damage is caused to the space or to the equipment in it by the orderer or anyone on his/her behalf, the orderer will bear responsibility for any damage caused.
The orderer undertakes to vacate the room on time, when it is empty of any person and object for which permission to leave has not been received. If there are evacuation expenses due to failure to comply with this commitment, after reasonable notice, they will be imposed on the orderer's account.
The orderer confirms that after clarification with him/her, Sahkuna is entitled to charge for all damages and malfunctions caused to the building negligently or maliciously due to his/her activity in the complex, insofar as they do not result from defects in the building or reasonable wear and tear.
Sahkuna has the right to switch between rooms that were reserved in the same size category, and the orderer will have no claim against Sahkuna because of this. The scheduling board of the spaces is updated online and does not allow cross-scheduling.
Other participants and center staff must be treated with respectful behavior, with special attention to the staff members with special needs. Offensive comments or dismissive behavior must be avoided.
Dangerous or special activity cannot be conducted in the space, including stage stunts or acrobatic activity, without professional insurance. Sahkuna is not responsible for damages caused during rehearsals to participants.
Storage of props and scenery, for the rehearsal period only, will be done with additional payment and in advance coordination.
Food or drink must not be brought into the space area, except water in a closed bottle.
There is an absolute prohibition on smoking in the space and in the building. Smoking is permitted only outside the building.
The community centers in which Sahkuna activity is conducted have the right to instruct Sahkuna to remove users who do not meet the above terms of use, after clarification. In the case of removal of a user after clarification, if the user has future orders that have already been scheduled for the rest of that month and cannot be fulfilled due to the removal, a proportional credit will be given for those future orders that were not fulfilled, according to the proportional part of the hours that were ordered and not used.
It is clarified that since the charge is made at the end of the month for uses that were made, the credit will be given by offsetting from the relevant monthly charge amount, or if there is no charge in that month, within the following account, at Sahkuna's discretion.
Orderer's Responsibility
The orderer hereby declares and undertakes that the responsibility for the use that will be made of the space by him/her and/or anyone on his/her behalf will fall on him/her and him/her alone, and that Sahkuna will have no responsibility for any bodily or property damage, including theft, that will be caused to the orderer or anyone on his/her behalf during and as a result of the use of the space
. The orderer will indemnify Sahkuna for any claim filed against Sahkuna by a third party, which results from use of the space made by the orderer and/or anyone on his/her behalf.
Insurance
It is hereby brought to the orderer's attention that Sahkuna and/or the community center hold fire insurance, as well as liability insurance towards third parties for their direct activity or the activity of anyone on their behalf, including in relation to participants. There is no contents insurance for the building, and any leaving of objects in the complex area is solely the user's responsibility.
It is hereby clarified that the existence of the above insurances does not impose any responsibility on Sahkuna towards the orderer, and does not constitute a commitment regarding the scope or quality of the insurance coverage. An orderer who finds it appropriate to purchase any personal insurance for himself/herself for the use of the space, is entitled to do so at his/her expense.
